Interim Measures

 

The Hong Kong Maritime Arbitration Group (HKMAG) is very pleased to announce that the Department of Justice has confirmed HKMAG as a qualifying arbitral institution, eligible to apply to the mainland courts for interim measures. 

The DOJ and the Supreme People’s Court signed the Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland and of the Hong Kong Special Administrative Region (Arrangement) on 2 April 2019.  Hong Kong became the first jurisdiction outside the Mainland where, as a seat of arbitration, parties to arbitral proceedings administered by its arbitral institutions would be able to apply to the Mainland courts for interim measures.

The Arrangement will come into effect on 1 October 2019, and will apply to all applications for interim measures made to the courts on or after that date.

HKMAG has developed Procedures for the Administration of Arbitration under the HKMAG Terms, which Parties may adopt wholly or partially before or after a dispute has arisen.
